Vanguard Furniture Company, Inc. (“Vanguard,” “we,” “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information through the Vanguard Furniture website (the “Site”) and the Vanguard Furniture App (the “App”), and the choices and rights you have.

This policy covers information collected through the Site and App. It does not cover information collected by our independent authorized retailers, who have their own privacy practices. The Site and App is intended for users in the United States and Canada.

1. Information We Collect

In the past 12 months, we have collected and will continue to collect the following categories of personal information:

  • Identifiers and contact information: name, email address, phone number, mailing address, IP address. Source: contact forms, login accounts, your device.
  • Professional or business information: company name, job title, business address, dealer or designer status, resale certificate or tax ID number. Source: trade account applications.
  • Account credentials: username and password. Source: trade accounts and consumers.
  • Commercial information: trade orders, quotes, and account history. Source: trade accounts.
  • Internet or network activity: pages viewed, links clicked, time on site, referring website, browser and device type. Source: Google Analytics cookies (with your consent).
  • General location: city or region inferred from IP address. Source: Google Analytics (with your consent).
  • Inquiry content: anything you choose to include in a message to us. Source: contact forms.

We do not sell products to consumers through the Site and do not collect payment card information from consumers.

2. How We Collect Information

  • Directly from you. When you fill out a contact form, create or use a consumer account, apply for or use a trade account, place a trade order, or email or call us.
  • Automatically. If you click “Accept All Cookies,” Google Analytics uses cookies and similar technologies to collect information about your device and how you use the Site. If you choose “Accept Only Essential Cookies,” we do not load Google Analytics.
  • From your business. For trade accounts, we may receive information about you from your employer or the business you represent, such as when a colleague adds you as a user on the account.

3. How We Use Information

We use personal information to:

  • Respond to your questions and requests
  • Review trade account applications, verify trade status, and manage trade accounts; create and manage consumer accounts
  • Process, fulfill, and support trade orders, quotes, and claims
  • Send product, promotional, and event information to trade customers who have not opted out
  • Understand how visitors use the Site and App and improve its content and performance
  • Protect the security of the Site and App, our systems, and our customers, and prevent fraud
  • Comply with legal obligations and enforce our Terms of Service

We do not send marketing email to consumers who contact us through the Site. We use your information only for the purposes listed here, or for purposes compatible with them, unless we ask for your consent.

4. How We Disclose Information

We disclose personal information only as described below:

  • Service providers that help us operate our business under contracts that limit their use of the information to services for us. These include web hosting and IT support providers, our email marketing platform, and our customer relationship management (CRM) and enterprise resource planning (ERP) systems.
  • Analytics provider. Google LLC provides Google Analytics for us, only if you accept analytics cookies. Learn more at How Google uses information from sites that use its services.
  • Legal and safety. When required by law, subpoena, or court order, or to protect the rights, property, or safety of Vanguard, our customers, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of all or part of our business.
  • With your direction or consent.

We do not sell personal information, and we do not share it for cross-context behavioral (targeted) advertising. We have not done so in the past 12 months.

5. Your Privacy Rights

Depending on where you live, including California, Colorado, Connecticut, Texas, Virginia, and other states with consumer privacy laws, you may have the right to:

  • Know and access the personal information we have about you, including the categories, sources, purposes, and recipients
  • Get a copy of your personal information in a portable format
  • Correct inaccurate personal information
  • Delete personal information we collected from you, subject to legal exceptions
  • Opt out of the sale or sharing of personal information, targeted advertising, and certain profiling (we do not do these)
  • Not be discriminated against for exercising any of these rights

How to submit a request. Email privacy@vanguardfurniture.com or call toll-free 1-800-968-1702. We will verify your identity by matching information you provide with information we hold, and we may ask for more information if needed. We respond within 45 days, or tell you if we need up to 45 more days.

Authorized agents. You may use an authorized agent to submit a request. We may require written permission signed by you and may ask you to verify your identity directly.

Appeals. If we deny your request, you may appeal by emailing privacy@vanguardfurniture.com with “Appeal” in the subject line. We will respond in writing within the time required by your state’s law. If you disagree with the result, you may contact your state attorney general.

These rights also apply to personal information about trade customers where state law covers business contacts, as California’s law does.

6. Your Choices: Cookies and Marketing

  • Cookies. When you first visit the Site, you can choose “Accept All Cookies” or “Accept Only Essential Cookies.” Essential cookies are needed for the Site and the trade portal to work. You can change your choice at any time by clearing cookies in your browser.
  • Marketing email. Trade customers can unsubscribe from marketing email at any time using the link in any message, or by emailing privacy@vanguardfurniture.com. We will still send messages about your account and orders.

7. Sensitive Personal Information

We do not ask for sensitive personal information through the Site, such as Social Security numbers, health, biometric, racial or ethnic, religious, or precise geolocation data. The only sensitive information we collect is account login credentials (username and password) for trade and consumer accounts, which we use only to give you secure access to your account. We do not use or disclose sensitive personal information to infer characteristics about you. Please do not include sensitive information in contact form messages.

8. Children’s Privacy

The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us personal information, contact privacy@vanguardfurniture.com and we will delete it.

9. How Long We Keep Information

We keep personal information only as long as needed for the purposes in this policy, or as required by law:

Trade account and order records While the account is active, plus 7 years for tax, accounting, and warranty purposes
Consumer account records While the account is active, plus 3 years after it is closed or inactive
Marketing email lists Until you unsubscribe or the trade account closes
Google Analytics data 14 months
Privacy request records 24 months, as required by California regulations

When the retention period ends, we securely delete or de-identify the information.

10. How We Protect Information

We use reasonable administrative, technical, and physical safeguards to protect personal information. These include encrypted (HTTPS) connections, password-protected trade and consumer accounts, and access limited to employees and service providers who need it. No website or system is completely secure, so we cannot guarantee absolute security. Please keep your login credentials confidential and tell us promptly if you believe your account has been compromised.

11. Do Not Track

Some browsers send a “Do Not Track” (DNT) signal. Because there is no common industry standard for DNT, the Site does not respond to DNT signals. You can decline analytics cookies at any time, as described in section 6.

We review this policy at least once a year. If we make changes, we will post the updated policy here and change the “Last updated” date. If we make material changes, we will provide notice on the Site and App, or by email before the changes take effect.

13. State-Specific and Canadian Disclosures

California. Sections 1 through 9 are our Notice at Collection and the disclosures required by the California Consumer Privacy Act, as amended. We do not disclose personal information to third parties for their own direct marketing purposes, so California’s “Shine the Light” law does not apply to us.

Nevada. We do not sell covered information as defined by Nevada law.

Other U.S. states. Residents of states with consumer privacy laws may exercise the rights in section 5, and the appeal process described there applies.

Canada. We process personal information of Canadian residents with your consent, which you can withdraw at any time, subject to legal or contractual limits. You may request access to or correction of your personal information using the contact details in section 12. Your information is stored and processed in the United States by us and our service providers, and may be accessible to U.S. authorities under U.S. law. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.
